AB 2895 by the Assembly Committee on Labor & Employment will require employers to make copies or allow inspection of all records produced by the employer relevant to implementation of the employer’s Injury and Illness Prevention Program (IIPP) to workers or their designated representatives. According to the Committee staff, AB 2895 was introduced in response to reports of disproportionally high levels of workplace injuries among Hispanic workers, which triggered a Labor & Employment Committee oversight hearing on Hispanic worker workplace injuries earlier this year.

AB 1167 (Connie Leyva, D-Chino) directs the Division of Occupational Safety and Health to propose an indoor heat illness standard to the Cal/OSHA Standards Board no later than July 1, 2017. The bill specifies this standard must be no less protective of workers than the Heat Illness Prevention standard for outdoor workers.

The State Water Board submitted the emergency regulation they adopted in January to the Office of Administrative Law (OAL) this week. The emergency regulation requires all surface water right holders and claimants to report their diversions annually.

The emergency regulation requires those with a claimed right to take 1,000 acre-feet of water or more per year to have a measuring device or measuring method capable of recording at least hourly in place by Jan. 1, 2017; those with claimed rights to divert 100 acre-feet or more must comply by July 1, 2017, and record at least daily; those with claimed rights to divert more than 10 acre-feet must comply by Jan. 1, 2018, and record at least weekly; and those who divert to storage of less than 10 acre-feet must comply by Jan. 1, 2018, and record at least monthly. Farm Bureau will submit written comments to OAL by the comment deadline, March 15th. Additionally, Farm Bureau is meeting with the new Assembly Water, Parks and Wildlife Committee Consultant to define the challenges caused by these newly adopted regulations.

The Department of Water Resources has extended the deadline to submit written comments on the Draft Groundwater Sustainability Plan Regulations. DWR will host three public meetings and a statewide webinar to solicit comments on the Draft GSP Emergency Regulations. Farm Bureau will submit comments.
